About Mediation

Mediation is required in most civil actions in Texas.  The mediator is a neutral third party whose goal is to guide the process and offers no legal advice, does not advocate for either party nor makes any agreements or decisions for the parties; parties are solely responsible for the terms of the final agreement.

Mediation is a confidential process and all negotiations, terms and discussions will remain confidential by all parties and the mediator unless otherwise required by law or by agreement by all in attendance. The mediator is prohibited from making any report to the courts beyond that it took place, attendance and its successfulness.  Regardless of the mediator being a licensed attorney, the mediator offers no legal advice nor advocates for either side. Each party is strongly encouraged to either have their own counsel present or obtain independent legal advice prior to signing any written legal agreements.​​​​

Mediation Services

Time & Duration

A typical full-day mediation begins at 9:30 a.m., includes a working lunch and continues until completed. While most sessions conclude by approximately 5:00 p.m., a session may extend into the evening. Three-hours and Four-hours mediations usually begin at 9:00 a.m. (morning) or 1:00 p.m. (afternoon). Weekends are available for mediation, if requested by all parties OR required by scheduling limitations. If the mediation session occurs on a weekend, a supplemental charge of $200-$400 will be allocated amongst the parties for support staff overtime and building HVAC costs.
 

Description of Services & Expenses

  • Scheduling and administering the session

  • Any pre-mediation attorney conferences

  • Preparing for and conducting the mediation session

  • Conducting the post-session telephone facilitation and correspondence as needed

  • Refreshments for all present

  • Lunch for all present (Full Day only)

Cancellation or Rescheduling Policy

A cancellation or rescheduling fee is charged only if the mediation is canceled or rescheduled. If the cancellation or rescheduling occurs 3 days prior to the scheduled mediation a $200 fee is charged to the party or parties canceling or rescheduling the mediation. If the cancellation or rescheduling occurs 2 days prior to the scheduled mediation a $400 fee is charged to the party or parties canceling or rescheduling the mediation. If the cancellation or rescheduling occurs 1 day prior OR on the day of the scheduled mediation the FULL amount of the mediation is charged to the party that cancels or reschedules.
